How Long is a Construction Certificate Valid for in NSW?

A Construction Certificate doesn't expire on its own. But the Development Consent it's attached to does, and when the consent lapses, the CC goes with it.

That distinction catches more builders and developers off guard than it should.

The link between a CC and a DA

Under the Environmental Planning and Assessment Act 1979 (NSW), a development consent generally lapses five years from the date it becomes operative, unless construction has physically commenced. Your Construction Certificate is issued under that consent. If the consent lapses, so does the CC.

Monitoring the operative date of your Development Consent, not just the issue date of your CC, is the starting point for managing approval risk on any project.

What counts as ‘commencing construction’?

The distinction is very important. Holding a Construction Certificate is not enough to prevent a consent from lapsing. To preserve the consent, development must have physically commenced in accordance with the requirements of the EP&A Act.

Generally, this involves carrying out physical building work that forms part of the approved development, such as excavation for footings, foundation works or structural construction.

A few things that do not count as commencement include:

  • Demolition of an existing structure (unless demolition forms part of the approved development)
  • Site clearing or preparation works not directly related to the approved building work
  • Installation of temporary site facilities, such as site sheds or hoardings
  • Surveying, pegging out or setting out the site

If your project is approaching a consent's lapse date, don't assume preliminary activity will preserve the approval. This is exactly the kind of question worth raising with your certifier early, before the date, not after.

What about Complying Development Certificate (CDCs)?

Complying Development Certificates combine planning and construction approval in a single document, but they come with their own commencement and completion timeframes. These vary depending on the type of development and the relevant planning provisions.

Don't assume the same five-year window applies to a CDC. Always review the specific conditions of the certificate.

What happens if a consent lapses?

A new development application is usually required, along with a new Construction Certificate before work can start. Any changes to planning controls, BCA requirements or local provisions since the original approval may apply to the new application.

For projects involving significant investment in design, engineering and approvals, allowing a consent to lapse can result in substantial additional time and cost.

Can a lapsing consent be extended?

In certain circumstances, yes, but that process sits with the council or consent authority. It's not something a private certifier is involved in. If extension is on the table, Buildcert can advise on the approval pathway once you're ready to recommence.

One important exception worth noting: under temporary COVID-19 measures introduced by the NSW Government, development consents granted before 25 March 2020 were automatically extended by two years. All consents granted between 25 March 2020 and 25 March 2022 were given a fixed five-year lapsing period. These measures are no longer in place, but if your project was approved during that window and you're uncertain how those provisions affected your consent, it's worth clarifying before assuming anything has lapsed.

What this means in practice
